Terms and Conditions of Sale

Terms and Conditions of Sale for the Guest and Philips Website

These Terms and Conditions apply to all orders for products placed with Guest and Philips via our website. You need to read these Terms and Conditions carefully before ordering any products from our website. None of your statutory rights are affected by these Terms and Conditions.

1. Availability of Products
All internet orders are subject to availability of product stock. If we are unable to deliver products that you have ordered we will notify you by email or telephone. If we have received payment for any goods, including any delivery charges for unavailable products, we will refund them to you within 30 days.

2. Confirmation and Acceptance of Your Order
When you place your order, using our website, you will receive an email confirming your order, the price you will pay, including any additional charges. It will be sent to the email address you provided when placing your order. You will also receive an email confirming that payment has been made and accepted. Both of these emails, or in some cases a combined email, are sent automatically. This does not mean that we have accepted your order.  We will notify acceptance of your order by sending an email to you stating that your order has been accepted and despatched. Only when we have accepted your order is a binding contract created between us.

3. Payment of Your Order
We must receive payment for the products ordered and the delivery charges made before we can accept your order. Once we have received payment or it has been authorised we will confirm this to you in an email. This may be an email also confirming the details of your order. It is your responsibility to check your order, that it is correct and you have been charged the correct price. We reserve the right to refuse or amend your order and also to restrict the number of products you can order in one order or multiple orders.

4. Images, Photographs and Product Descriptions/Details
All the images and descriptions shown on our website are to give an approximate idea of the characteristics and appearance of the products being described. They should not be used or relied upon as accurate or final. Any product dimensions supplied are only an indication of the size of individual items and are not to be relied upon as accurate. The photographs or images of products may not be to actual size and cannot be relied upon as a faithful reproduction.  If you wish to view a product before purchasing it, please contact one of our shops and arrange a visit.

5. Prices, Taxes and Delivery Charges

Prices shown on the Guest and Philips website are in Pounds Sterling and are inclusive of VAT at the prevailing rate where applicable. We reserve the right to change prices at any time and the price(s) we charge will be the current price(s) at the point we accept the order (see point 2).

Whilst we try to ensure that all prices on our website are accurate, errors sometimes occur.  If we discover any error in the price(s) of products you have ordered we will contact you as soon as possible. We will give you the option to either reconfirm your order at the correct price or allow you to cancel it.  If we are unable to contact you we will treat the order as being cancelled and will refund any money owed.

As the purchaser you are responsible disclosure and payment of any import or other duties which apply in the country to which the products are going to be delivered.

Delivery charges can apply and if so will be displayed during the order process.

6. Despatch and Delivery
Our aim is to get your orders despatched in 3 to 5 days (unless agreed otherwise e.g. Express Delivery). However please allow up to 30 days for delivery of your order. We will deliver products ordered by you to the address you provide to us. This address will be confirmed in our confirmation email. All deliveries must be signed for. You will not become the owner of the goods until they have been delivered and signed for by you. As soon as this happens they will become your risk and we will not be liable for any subsequent damage, loss or destruction of them. Overseas orders will have their delivery time quoted separately by email.

7. Right of Cancellation

The United Kingdom's Consumer Protection (Distance Selling) Regulations 2000 give you the right to cancel your order at any time up to the end of the seventh working day, starting from the day after your delivery was made. You do not need to give us a reason for cancellation.

Because of hygiene and public health reasons you cannot cancel your order for any jewellery which passes through the skin (such as earrings for pierced ears). Once we have dispatched these types of products to you, you cannot return them.

If you wish to cancel your order during this period please fax us on +44 (0)1482 866485 or email us at order@guestandphilips.co.uk giving all your order details. If the product has already been despatched you must return it to us at your own expense. Any costs not covered will be deducted from your credit. We recommend you use an insured and signed for courier service when returning any product to us.

8. Faulty Product

If a product is faulty in your estimation, please contact us at order@guestandphilips.co.uk and describe what it is that is faulty about the product. We will then contact you with the alternatives courses of action available to you. One option will always be a refund but we may also offer a replacement or alternative item. Before returning the item it is important you contact us so that we can make arrangements for the return and, if requested, replacement of the product or a refund.

Before you return a faulty product you must take reasonable care of it. On receipt we will examine the product and if found faulty, and you request a refund, we will charge the price of the product and our delivery charges to your credit/debit card.

None of your statutory rights as a consumer are affected.

9. Warranty
Products bought from Guest and Philips are guaranteed against defects in materials and workmanship for at least 12 months from the date of purchase unless otherwise stated. Goods may be returned to us, if considered faulty by the purchaser, at any time during their warranty period. If, after having the opportunity to inspect a product, we are satisfied that it is faulty the n we will exchange or refund the product. Any refund will be at the price paid and not the current price. Purchasers must provide us with the original invoice or despatch note that came with the delivery. A copy of any emails will not do.

If we supply a replacement product the warranty applies to the replacement product for the balance of the warranty period for the original product.

The warranty does not apply in any case where the defect is due to the product not being cared for or where the product has been modified, misused, or willfully or accidentally damaged.  This warranty is not transferable to a new owner of the product.

None of your statutory rights as a consumer are affected.

10. Pre-owned Products
Pre-owned (antique or secondhand) products are products which have previously been owned by another person and their condition, appearance and value are as described on our website. As pre-owned products have previously been owned and/or used they may contain marks, surface damage or defects resulting from wear and tear due to their age and use.  

Our warranty (as in condition 9) only applies to these products for any new defect. Any defects which have been notified to you before or when buying the product are not deemed to be defects for the purpose of the warranty.

11. Complaints and Liability
All complaints should be addressed to Customer Services, Guest and Philips, 23-24 Saturday Market, Beverley, East Yorkshire HU17 8BB, United Kingdom.
If our products are not as described, are damaged, defective or you have been sent an incorrect quantity or quality you should contact us within 14 days of delivery. We will replace the incorrect, damaged or defective products or make good the shortfall in quantity. At our discretion we may credit the price and delivery charges to your credit/debit card or send you a cheque for the amount to be refunded.

If you do not receive the products you have ordered you should notify us within 45 days of the date of your order. We will organise to deliver the products ordered or, at our discretion, credit the price and delivery charges of the non-delivered products to your credit/debit card.

Our liability for loss or damage is limited to a sum equal to the amount paid or payable by you for the products that are the subject of any claim.
This does not include or limit in any way our liability for any of the following: any breach of the obligations implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982; losses for which it is prohibited by section 7 of the Consumer Protection Act 1987 to limit liability; death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other matter for which it would be illegal or unlawful for us to exclude or attempt to exclude our liability.

Subject to the exclusions listed in these Terms and Conditions if either party fails to comply with these Terms and Conditions, neither shall be responsible for any losses suffered by the other, except for any losses which are a foreseeable consequence and a failure to comply with these Terms and Conditions.

Neither party shall be responsible for losses that result from a failure to comply with these Terms and Conditions including Loss of income or revenue; Loss of business; Loss of anticipated savings; Loss of data. This shall not prevent claims for foreseeable loss of, or damage to physical property.

We are under no liability for any delay or failure to deliver products or perform any obligation specified in these terms and conditions if the non-performance is wholly or partly caused by circumstances beyond our reasonable control.

12. Validity
If any of these Terms and Conditions are found to be unenforceable it shall not affect the enforceability of the rest of these Terms and Conditions.

13. No Variation or Representation
Other than as stated in these Terms and Conditions, nothing said or communicated by any member of Guest and Philips staff shall amount to any variation of these Terms and Conditions or represent the nature or quality of our products or our offer.

14. Third Party Rights
Nothing in these Terms and Conditions shall give any person, who is not a party to the contract, any benefit or any right to enforce any of the terms of the contract.

15. Governing Law and Jurisdiction
The contract shall be deemed to have been formed under and shall be governed and interpreted in accordance with English law. The English Courts shall have jurisdiction to hear disputes between Guest and Philips and any other party.

16. Proprietorship
Guest & Philips is a partnership owned by Michael, Anne, Philip & Karen Guest, based at 23-25 Saturday Market, Beverley, East Yorkshire. HU17 8BB.
Guest & Philips is a member of the National Association of Goldsmiths. The Value Added Tax Registration Number is 282 2692 45.

Order Cancellations and Returns...

Cancelling an Order
If you wish to cancel your Guest & Philips order please fax us on +44 (0)1482 866485 or email us at order@guestandphilips.co.uk giving all your order details. We will try to stop the order, however if the product has already been despatched you must return it to us at your own expense (see details under Unwanted Items below). Any costs not covered will be deducted from your credit. We recommend you use an insured and signed for courier service when returning any product to us.

Unwanted Items
If you want to return an unwanted item to Guest & Philips please send it with a completed copy of our returns form and a copy of your invoice to:

You must return the item to us at your own cost. Any costs not covered will be deducted from your credit. We recommend you use an insured and signed for courier service when returning any product to us.

Faulty Items
If a product is faulty, please contact us at order@guestandphilips.co.uk and describe what is faulty about the product. We will contact you with the alternatives available, we will always offer a refund but we may also offer a replacement or alternative item. When returning the item follow the procedure above for returning Unwanted Items. It is important you contact us first so that we can make arrangements for the return and, if requested, replacement of the product or a refund.

Until you have returned the product to us, you must keep it in your possession and take reasonable care of it. We will credit the price of the product and our delivery charges to your credit/debit card.

All products bought from us are guaranteed against defects in materials and workmanship for 12 months from the date of purchase. ??If within that period after having opportunity to inspect a product we are satisfied that it is faulty as a result of a defect in materials or workmanship, you may return the product to us for an exchange or refund of the price of the product. You must provide us with the original invoice, despatch note or other proof of purchase.
